1. Acceptance of Terms

By accessing or using Dark Romance Studio ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use this Service. By using Dark Romance Studio, you represent and warrant that you are at least 18 years old. The Service contains AI-generated content that may include mature themes, including but not limited to dark romance fiction, suggestive imagery, and adult-oriented creative content. This Service is not intended for minors.

3. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Service Description

Dark Romance Studio is an AI-powered content creation platform specializing in dark romance fiction, imagery, book covers, advertisements, and related creative content. The Service provides tools for generating stories, images, video content, and marketing materials using artificial intelligence technology.

5. Subscription Plans & Billing

The Service offers the following tiers:

  • Free: Limited access with 3 AI-generated images, 3 story chapters, 1 book cover, and 1 ad graphic. Exports are watermarked.
  • Pro ($20/month or $197/year): 2,000 credits per month, all creation tools unlocked, HD exports without watermarks, and email support.
  • Unlimited ($149/month or $1,297/year): Unlimited generations, priority processing, bulk generation, commercial use rights, all premium styles, 4K exports, and dedicated support.

Additional credit bundles may be purchased separately. Subscriptions auto-renew unless cancelled before the end of the current billing period. You are responsible for all charges incurred under your account.

6. AI-Generated Content Ownership

Content generated using Dark Romance Studio is subject to the following ownership terms:

  • Free tier: You may use generated content for personal, non-commercial purposes only. All exports include a watermark.
  • Pro tier: You receive a non-exclusive license to use generated content for personal and limited commercial purposes. You may not resell generated content as standalone products.
  • Unlimited tier: You receive a broad commercial license to use generated content for commercial purposes, including but not limited to book publishing, merchandise, advertising, and content sales. This license is non-exclusive.

We do not claim ownership of content you generate. However, we retain the right to use anonymized, aggregated data to improve our AI models and services. You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions.

7. Prohibited Uses

You agree not to use the Service to:

  • Generate, distribute, or store any content depicting minors in sexual or exploitative situations. This is an absolute prohibition with zero tolerance.
  • Generate content that promotes real-world violence, terrorism, or illegal activities.
  • Impersonate real individuals without their explicit consent.
  • Generate content for the purpose of harassment, defamation, or intimidation.
  • Circumvent usage limits, access controls, or security measures.
  • Use automated tools (bots, scrapers) to access the Service without authorization.
  • Redistribute, sublicense, or resell access to the Service itself.

8. Content Retention & Deletion

Generated content stored on our servers may be automatically deleted after 10 days. You are solely responsible for downloading and backing up any content you wish to retain. We are not liable for any loss of content due to automatic deletion or system failures. Paid subscribers may have extended retention periods as specified in their plan details.

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARK ROMANCE STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Dark Romance Studio, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dark Romance Studio operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with applicable arbitration rules, unless prohibited by local law.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
